Update: Man sues IBM for Porn Addiction

Earlier this year CP80 followed a story detailing that lawsuit of James Pacenza, a former IBM employee who was fired after 15 years for viewing Internet pornography at work.

Mr. Pacenza said that his addiction to pornography was caused be stress from his time as a soldier in Vietnam. He went on to say that he attempts to "self-medicate" his addiction by indulging it - that means viewing pornography and participating in explicit chats online.

Mr. Pacenza is arguing that his addiction should be protected under the Americans with Disability Act and that he was wrongfully terminated. He is suing IBM for $5 million.

In an opinion piece written for the Sierra Sun, one lawyer points out that, while we can assume that the federal court will rule in favor of IBM, the implications of a ruling for Mr. Pancenza are frightening. The author said: "If an employee must be allowed to “self-medicate” his or her psychological problems by visiting adult chat rooms while at work, it will be impossible to regulate Internet use in the workplace."

CP80 firmly believes that employers, like families, should have the right to choose and control what content and behavior is acceptable within their private environments.
